Loss of Bt20 bn predicted, if buyer can be found

Singapore state investment firm Temasek Holdings stands to lose more than Bt20 billion if it were to sell off its controversial majority holding in Shin Corp, financial experts believe.

Brokerage analysts said Temasek, which controls about 96 per cent of Shin Corp, might have to sell up to 47 per cent of the company, or 1.5 billion shares, to resolve the foreign ownership dispute.

Thai law restricts foreign interests in Thai firms to below 50 per cent, so Temasek must reduce its holding by 47 per cent to meet the 49 per cent limit.

The 47 per cent stake in Shin Corp is now worth a market price of Bt52.32 billion, compared with Bt74.14 billion in January this year - a loss for Temasek of more than Bt20 billion.

On Monday, Temasek issued a statement to clarify its willingness to reduce its holding in Shin Corp at an appropriate time to ensure an orderly market. However, it has not yet addressed the question of whether it breached Thai law by allegedly relying on nominees to take over Shin Corp.

A fund manager said Temasek might want to complete the share sale in November, before a court verdict on whether to revoke the licences of Shin Corp subsidiaries due to Temasek's alleged violation of foreign ownership law.

But other analysts believe Temasek might find it very difficult to find potential buyers.

"Temasek is looking for potential buyers but it may not be able to conclude the deal by November because it involves lots of money," said an analyst.

He said only a handful of Thai companies such as Siam Cement, Charoen Pokphand (CP) and Thai Beverage Plc have enough cash to acquire the Shin Corp stake.

However, Thai Beverage is unlikely to buy Shin Corp shares because its chairman Charoen Sirivadhanabhakdi is reluctant to get involved in political issues. CP is also unlikely to spend a huge amount of money on such a move, said the source.

Now, the focus is on Siam Cement and Siam Commercial Bank (SCB), both partially owned by the Crown Property Bureau. But the source quoted a senior official at Government House as saying Siam Cement or Siam Commercial Bank's buying into Shin Corp "could never happen".

SCB has an indirect interest in Shin Corp, but Khunying Jada Wattanasiritham, the bank's president and CEO, said "there's no reason for SCB to buy more Shin Corp shares".

Korn Chatikavanij, deputy secretary-general of the Democrat Party, also discounted the possibility of Temasek finding any Thai buyer for its Shin Corp stake in the near future.

"Who would want to step in now? There are several contentious legal problems surrounding Shin Corp. Not to mention the case against Shin Corp at the Administrative Court," he said.

Temasek bought 49 per cent of Shin Corp from the Shinawatra and Damapong families in January this year. In a subsequent public tender for the remaining shares Temasek, through Cedar Holdings and Aspen Holdings, snapped up almost everything and ended up controlling 96 per cent of the Thai company, leaving just 4 per cent as a free float.

Temasek's senior managing director Jimmy Phoon said in a statement on Monday the share reduction plan was part of his company's original intention, to maintain Shin Corp's listing status on the Thai stock market following Temasek's public tender offer in March. But he did not say how many shares it planned to sell to keep the stocks liquid in the market.

Seamico Securities Plc said the sale was inevitable. It predicted Temasek might have to sell 51 per cent to reduce the risk from the nominee controversy.

An analyst from Asia Credit Securities said Phoon's announcement was good news. "It should promote the free float of Shin Corp shares on the market and reduce foreign investors' worries on the future operation of Shin Corp," he said.

Local telecom operator Advanced Info Service (AIS) has 48.3 per cent of its shares held by foreigners. If foreign shareholders in Shin Corp are included, the foreign stake in AIS would be 91.1 per cent, much higher than the legal limit of 49 per cent.

"If Temasek wants to reduce Shin's foreign shareholders to 49 per cent, it has to sell around 1.547 billion shares," the analyst said.

"Now we have to see if Temasek sells the shares to institutional investors or to retail investors. And what will the conditions be for the sale," he queried.

Meanwhile Karun Kittisataporn, permanent secretary of the Commerce Ministry, said in spite of Temasek's intention to sell its stake, the ministry will continue with its legal action to follow up the Business Development Department's investigation on whether Kularb Kaew is a nominee of Temasek.

"It was a separate issue. The ministry will proceed with the case," he said.

Last month, the ministry concluded its investigation, finding that Kularb Kaew was a nominee of Temasek Holdings. The case was handed over to Tung-Mahamek police station. In the primary investigation, the department found it likely Kularb Kaew was in breach of the kingdom's Foreign Business Act.

Temasek's 2006 acquisition of Shin Corporation, owned by the family of
then Thai prime minister Thaksin Shinawatra, was particularly
controversial, with protestors burning effigies of Lee and Ho in the
streets of Bangkok[1]. The deal was a factor in exacerbating the Thai
political crisis, which eventually led to the downfall of Thaksin and a
review of the transaction's legality. The Ascott in Bangkok sit below 11
floors of luxury condominiums. Unfortunately two aprtments suffered a
series of break-ins and a mysterious man (Winn-Pope / Irwin) residing on
the 31st floor suspected of entering other apartments unauthorised has
been seen around the development. It appears he was involved in
terrorising some tenants and stealing their property and possibly ID
theft. The Ascott seemed to acept his existence regardless of several
thousand US$s of goods vanishing whilst he was around. He was formerly a
cheque signature forger from the UK. One of his claims is he is a UK
Police informant but we were told (that includes an International
Lawyer, that most of his information was wholly inaccurate and possibly
damaging to third parties who were innocent. He robbed his wife Helena
after smashing her up in a Mazda MX5 in Poland. Hospitalised with her
legs in traction he stole her cheque book and cleaned out her personal
(not joint) bank account. A thoroughly despicable but very happy
friendly fronted creature. Why were Temasek staff involved with a
criminal like Winn Pope formerly Mr Winn? Rental cars never returned
with only initial rental paid was another one of his past "jokes"
(possibly initially hired with someone elses unathorised use of credit
card details). I paid US$450,00 for property at the same building whilst
staff allowed unauthorised access to this property to urinate in drinks
steal goods and in one apartment commit the crime of arson, after he
fell through a suspended ceiling, the fire covering up the break-in. Yet
his smile and giggles gave him a go-anywhere in the building free card
for almost one year maybe longer.

The morning of the murder of Rachael Nichol (Nickell, Nichole,Nichols) Mr Winn-Pope formerly Mr Winn left Guildford by train with his wife Helena (a United Airlines Cabin Crew member). They left Guildford at about 5.30 - 6.00 a.m. together as she had to reach Heathrow for a flight.
think Winn-Pope then travelled on towards London as Helena changed trains or transport to reach Heathrow.
She may have disembarked at Woking which has a rail-air coach link.
He may have then disembarked at Wimbledon, this would have been around 7.00 a.m. in my opnion. What was he doing between then and 9.30 a.m. ? Why was he on Wimbledon Common when he was supposed to be attending a job interiew at The Brunswick Centre Chiswick. In fat that could be quickly reached from Heathrow by the undergrund railway.
I heard he was seemn getting a lift from someone near Wimledon common that morning and perhaps he then travelled down the A3 back towards Guildford. He did not attend his appointment with a Telecommunication equipment supplier in Chiswick. I also think he uses various names Irwin, Smith, Pope, Winn, Winn-Pope, Young (I think he may have used my name).
I have sen him on the road side in angkok near Petchaburi the day I took delivery of a new Range Rover Sport Supercharged which I bought for about 9.5 million baht in cash(bankers cheque).
The day I collected the car was a Sunday and Winn-Pope may have been into or near to the dealership. Perhaps he has a spare key ? I thnk he has spread many lies about me and been helping the Thai Police-Shinawatra in their hatecampaign against me that was wholly inacurate and illegal.

Asian Human Rights Commission slams Thai authorities for showing little interest in rectifying abuses

A new human-rights report accuses Thailand of gross violations, including the systematic torture of detainees, the disappearance of political activists, extrajudicial killings, and a perceived lack of interest on the part of the authorities to rectify abuses.

The 116-page report released by the Asian Legal Resource Centre, in conjunction with the Hong Kong-based Asian Human Rights Commission (AHRC), describes Thai-land as a land where not the rule of law but rather the "rule of lords" prevails.

"On paper Thailand adheres to the rule of law; in practice it is still subjected to the rule of lords. Ancient authoritarian practices and thinking are still very much in place [and] the Army is allowed to kill at random, the police permitted to torture at will," charges the report, which will be presented to the UN Human Rights Committee meeting on Thailand in July.

I still have no answers to the dead people in my family and friends some I conclude were preplanned killings by people integrated with the THAI CIA MAFIA of the Sophonpanich Heroin Cartel.. Then the Thai CIA and their UK accomplices became involved in defrauding me discrediting my family threatening to kill my children family and friends and polluting the atmosphere with Satanic Games that kill people.
They taunted and lied to my third wife and one of their colleagues pushed her into using HEROIN. I hope they go to prison for eternity. They then planned to fit up my girlfriend, who was not Thai, having ruined my life with my third wife.
It seems they are the World's lowest level of cheap scum cowards who use women and children as weapons to blackmail and injure their target. They think they are going to take all my assets. I will fight for a full scale war to be declared by the World to erradicate these Satanic criminals, who fitted up Pol Pot and the Khmer Rouge, for their killing fields where they executed millions of people in a satanic killing orgy.
It appears they have been involved in selling body parts from children and I believe there is a case to investigate where they used a meat butcher as the surgeon on these children... Ronald was also the man that launched Macdonalds for the Sophonpanich Heroin trade to have a laundering service that would become global.. A BRITISH survivor of the fire horror in a Bangkok club that left 60 people dead has told how he was saved from death by the hand of an angel.

Alex Wargacki, 29, collapsed unconscious as fire raged through the Santika club in the Thai capital. More than 200 were injured, including four Britons.

Alex said: “I woke up and heard this voice saying, ‘Come on. Come on this way.

“Then I felt myself being dragged towards an exit. A crowd of people parted in front of me and then I was out in the open air.

“Had it not been for this voice with the hand of an angel I would not be alive today.

“The voice sounded as if he was Thai. Maybe he was one of the people at the New Year’s party.

“Maybe he was a fireman. But when I get out of hospital, I want to thank him for sure.”

Alex, a trader from London, saw the fire starting in the club at about 12.30 am on New Year’s morning.

He said: “To the right of the stage I saw a firework being let off among a crowd of people.

“It shot right across the room. It seemed no time at all and the whole place, walls and ceilings, were ablaze.”

Alex was taken to the Samitivej Hospital with fellow Brit Oliver Smart, 35, who last night was still unable to speak.

A hospital spokesman said: “One of his lungs totally collapsed. He has only been able to tell us his name, and that he was with his Thai girlfriend. She is being treated at another hospital.”

The other two Britons were named as Steven Hall, from south Wales, and Adam Butler.

Revellers complained that there was no sprinkler system in the Santika.

Although there were other exits, there were no signs pointing out where they were, so everyone fled to the front door.

Exits are often locked in Thai clubs for fear of people leaving without paying their bills.

The Foreign Office say they have not been notified about any British fatalities, although it was reported that a 34-year-old woman teacher had died.

The bodies of 32 people, who have been burned beyond recognition, have still to be identified.

Thai police raided a hotel room in Bangkok early today and arrested 13 men and ten women they said were taking part in a British organised ‘swingers party’.
The raid took place at Bangkok’s Elizabeth Hotel and a British man, Chris Richards, 54, and his Thai wife, the organisers of what police described as ‘a swinging sex tour,’ were charged with conducting an illegal commercial sex operation. They had charged participants each the equivalent of £62.
All the men were foreign; seven out of the ten women were Thai. The party included nationals from Britain, Australian, Bangladesh, Sri Lanka and Korea.
They also took away lubricant, pornographic materials and 30 Viagra pills.

Posters known as a ‘Brit_Thaicpl’ frequently advertise swinging parties on the internet through a Yahoo group known as ‘ThailandCentralSwingers’.
A promotion statement for the event states: “The evening starts normally like a cocktail party with people casually dressed to attract the opposite sex (no jeans or wellington boots) .
“People eat from the great buffet and help themselves to drinks from the wide selection with no limits and play slowly unfolds at each person’s own pace.

“It’s a great night and well worth coming to, you will see all styles of play.”
Legal note: Technically all entertainment establishments offering sexual services in Thailand are illegal. But they pay cash to police not to enforce the law.

I was attacked late afternoon by a security man whoi I recognise from the UK. He is probably hiding here under a stilen ID due to some problem he has in the UK Woking Surrey area. He is about fifty years old dark complexion 5ft 5inches tall and became quite agressive for no cause of intimidation he simnply jumped at me because he works for the heroin fraud and murder ring involved in terrorism from Woking and surrounding areas. I think he is just one more of the thousands of criminals that Shinawatra attracted into Thailand some with the assistance of Mr david Crawley aka Ernest Richard Crawley formerly known under the name of Smith his brother was Garnett Smith hios son in Malaysia Stephen Wiffin.
With the exclusion of Mr Crawley’s son the Shah brothers of Woking were always very pleasant people and I believe Crawley corrupted and wound up some of them with a series of lies about the family of Erik Young in return for payment from Thaksin Shinawatra aka Mr Sylvester.

I also beliee Crawley and his accomplices forged Surrey Police documents so people would believe I was a convicxted paedophile. The word paedophile means you are a sexuak abuser of Children. I think these people remember meeting Mervyn Young and his son Erik Young about ten years ago to discuss the condition of the Mosque and the ground rent.
