We, the Undersigned, endorse the following petition:
In Support of Mr. James Gomez and the Workers' Party

On May 7th, 2006, Mr. James Gomez of the Workers' Party (hereafter, the WP) was detained at the airport on his way to Sweden. Over the past week, the tale of whether Mr. Gomez, an opposition candidate, correctly submitted his election paperwork has dominated the news in the state-run media ahead of the General Elections 2006. Although Mr. Gomez had initially remarked that the Elections Department had misplaced his document, he had later, retracted this and apologized most sincerely for his absent-mindedness. However, the long-ruling People's Action Party (hereafter, the PAP) has used the incident to try to discredit the opposition as incompetent or worse, repeating a pattern seen in previous elections of singling out opposition figures for alleged abuses and making them the dominant campaign issue. Mr. Gomez has worked as a political researcher at international think-tanks, including Germany's Friedrich Naumann Foundation and currently the Stockholm-based Idea International, which promotes democracy in developing countries. In spite of this, Mr. Lee Hsien Loong and Mr. Lee Kuan Yew have continually attacked Mr. Gomez's character, and have refused to acknowledge his apology. The PAP and its members continue to allege that the WP had intended to discredit the Election Department, and thereby, Singapore's electoral system; the WP has refuted both charges.

1. We, the Undersigned, believe that the PAP is making a mountain out of a molehill. Last week, Mr. Lee Hsien Loong made a comment regarding his intentions to 'fix' the opposition MPs and 'buy' votes. These comments undermined democracy in Singapore, but he was allowed to retract his words with an apology from his Press Secretary. Therefore, we believe that this privilege should be extended to Mr. Gomez who has admitted and apologized for his mistake.

2. We, the Undersigned, demand an apology from Mr. Lee Hsien Loong, Mr. Lee Kuan Yew, and Mr. George Yeo for continually insisting their intentions to take legal actions against both the WP and Mr. Gomez, and demanding Mr. Gomez's withdrawal during the course of the election campaigns. The abovementioned individuals have continued to discredit Mr. Gomez and all other opposition members during public appearances in both the media and during the election rallies.

3. We, the Undersigned, believe that the PAP is undertaking a series of acts of revenge against the opposition parties after noticing a marked upsurge in their popularity.

4. We, the Undersigned, believe that the PAP is perpetuating fear and intimidation amongst Singaporeans in order to stifle public dissent by undertaking these legal actions against opposition members.

5. We, the Undersigned, believe that the PAP continues to suppress Singaporeans and deny us, of our democratic rights including freedom of speech and press, and the right to peaceful assembly.

6. We, the Undersigned, demand the immediate release of Mr. James Gomez and the return of his passport.

    As I have written in the comments of the previous post, please write responsibly and verify the facts before writing such remarks. There will and should be recourse of the law if James Gomez is guilty as such of criminal intimidation. The report was made by the Elections department and not the organisation of the People's Action Party.

    As a fellow blogger, I feel ashamed to be put in the same league as you, making such irresponsible comments. I may not support the PAP, but I believe that facts must be ascertained before groundless accusations as such you made should be put forth. You are guilty of misinformation and misguiding the public. Blog responsibly.

    Please clarify the inaccuracies within the petition, and the appropriate adjustments will be made. Pointing accusatory fingers at each other will not meet the desired ends.

    While it is true that it was the Election Department that had filed the complaint, one needs to ask whether this was an independent institute making these allegations or are these politically charged motivations? Afterall, the Elections Department waited till after the polls to make the complaint and one can only think why.

    Why did the Election Department wait till he is about to leave the country to be arrested? Sometimes, I wonder if WP did win the GRC. What will happen to James Gomez? I'm sure they'll make him a scapegoat for winning a seat in Parliament. If he really did make a mistake about his form, then why did the relevant authorities not just pull him off the bandwagon. Of course, I don't know if there is indeed criminal intimidation involved. Only James Gomez knows.

    hello! thanks for writing the petition i was looking for one to add my support to, over this issue.

    however your petition is a little too forceful, and makes some risky assertions, in my opinion. perhaps we should get it edited properly so that it only expresses what most people would feel about the incident/situation?

    i really like the idea of a petition, but at the same time i would prefer if it was a properly written one, which would give the petitioners more credibility. it should also only cover those aspects most people will likely agree on (i.e. that Gomez's detention is unfair, and should be reversed), so that more people would find their thoughts/feelings in agreement and sign. i'm sorry if i can only comment but cannot help to redraft this, because i am not confident i will be able to capture and leave out the right/wrong stuff. i hope this was useful.

    thanks for taking the time and effort to write a petition. i will check back and sign if i agree with what the petition states. i'll try and spread word about this too, right away!

    It shouldn't simply be about the detention. It should be about everything that had led up to it, which includes the defamatory remarks by the two Lees and George Yeo. The question is why is he being detained. He's being detained over the minority certificate issue. Why is this such a huge deal? The PAP has made it out be such, and they have continued to harp on it. This is a revenge tactic against the opposition members just as much the actions against Mr. Chee and Mr. Jayaretnam were. This is also a scare tactic to let Singaporeans know that dissent will not be tolerated by the government. These issues are significant, and the clauses are true, and therefore, need to be included in the petition.

    If Gomez is not found guilty with conclusive evidence, the WP should sue Lee & Co. for defamation. It is a clear case. It'll be another test to see if a judiciary is indeed independent.
    If Gomez is punished despite insufficient evidence, there should be a protest. We should not break the law, but we should not let the law be abused.
    If Gomez is indeed guilty, then he should face the consequences.

    Based on the news reports, it is highly unlikely that James Gomez committed a criminal offence by the laws of any country in the world that has an independent judicial system.

    Singaporeans should demand to know why he was arrested and then decide for themselves if his arrest amounts to intimidation by the police, the very thing that James Gomez is allegded to have done to the Elections Department.

    Perhaps it is timely for Singaporeans to also ask for a review of the justice system. For example I understand that if James Gomez had said publicly that the allegations made against him by the PAP leaders were not true, the PAP leaders could sue him for defamation on the basis that he implied that the PAP leaders were liars. This is ridiculous as all James Gomez would have done is to proclaim his innocence. If my understanding of this is correct then i think the law (or the judges that uphold such views) should be replaced.

    Another practice that does not seem right is the fact that Parliament does not have to approve the appointment of judges. This prevents the elected representatives of the people from reviewing the performance of the proposed judge and bringing to light any possible shortcomings. For example the current chief justice, while he was the attorney general, held that Goh Chok Tong had not committed the offence of being in the vicinity of a polling station during a previous election. The law as I understand it forbids candidates from being within a certain distance of a polling station. The attorney general's rationale was that Goh was seen in the polling station and not in the vicinity of the polling station and therefore did not commit an offence. I cannot understand this reasoning and I wonder if the best legal brains in Singapore support the view of the attorney general. Certainly this is a matter that I think the opposition MPs should raise in parliament.

    It's not just someone else's liberty, it's the liverty of all those staying in Singapore at stake and ppl here should understand that but we have instead many who suddenly say that Gomez and WP deserves it.

    I hope the posters who wrote those will have the same thing happening to them or their close ones so that they can understand how it feels. Then perhaps, they might be happy to hear when someone gloats over their misfortune?

    Just becos someone who have performed well for a corporation doesn't mean he is the only one who can do it. Furthermore, the things that he did may not really be in the interest of the shareholders...

    Think TT Durai for NKF. Who can say he is incompetent and incapable? Who can deny his stewardship that led NKF to grow to his gargantuan scale? But now, would anyone wants him to carry on as the CEO?

    Singaporeans think they can see the long term, the big picture. Would Singaporeans rush to topple Durai 2 years ago?

    To the petition writer:

    I just signed the petition, which is the right thing to do.

    However, please do take cognizance of some of the feedback posted here to refine the peition so that more people will come on board to support it.

    The petition should not be politically charged, it should appeal more to righteousness and justice, as well as for a more humane, compassionate society.

    We all know how brutal and ruthless the (old) PAP regime has been, we must make it known to him WE ALL Singaporeans have had enough of all the knuckle-busting and hatcheting at every election.

    Let's do the right thing for Gomez, for Singapore, for Singaporeans for the future.

    Reword the petition. The last thing you want is to give the authorities a reason to come after you for inciting mischief or open rebellion or something like that.

    The main point here is that Gomez made a gaffe but in this he was not alone. The PM said his share of regrettable things. So in the spirit of fairness, if the PM was allowed to explain away is error, so should Gomez.

    The last thing we should be concerned about is whether or not the government will find it necessary to deem us 'making trouble'. If the clauses in the petition are held to be true, why the need for rewording?

    The issue is not just Gomez's detention, it should be widened to everything that had led up to this, and why it's still being persued.

    Intro: "The PAP and it's members" --> should be "its"

    Section 1. "Mole hill" should be one word. Also, "Lee Hsien Loong" is misspelled in this section.

    I have signed the petition to lend my support, but I would be disappointed if the writer of this petition doesn't take public feedback into consideration.

    Thank you for all your feedbacks. Considerations are being discussed. Errors can only be adjusted on the Singapore Election Watch site, and not on the petitiononline site.

    If you're suggesting that clauses of this petition be amended, a new petition need to be drafted and all would be required to sign once more. This would be a hassle, but if there are large sticking points and many are unwilling to agree to its clauses, a new peition must be underway.

    Please continue to provide us with your feedbacks.

    Please note that this petition is not simply a means to voice our opposition and thereby let others in the boat to voice theirs. This is also a means to let people know of what the circumstances are, and by reading the clauses, Singaporeans will be much more aware of the circumstance of our system. Indeed, no one expects actions to be taken in regards to this petition, but one needs to analysize success not in terms of forcing the authorities to take the appropriate action, but also in terms of the capacity to spread the message. We hold these clauses dearly, and would hope that more Singaporeans realize that these clauses are significant and persists in our daily lives. We're simply too oblivious to realize.

    Let's make the petition a good one. You've said

    I can offer one point. A lot of posts have mentioned the word "arrested". I'm puzzled that the official media used words such as "interview" or maybe "assist in investigations". Hence I'm not at all sure if in fact Mr Gomez had been arrested at all.

    A side issue on this same point: it is evident now that Mr Gomez is not in detention, whether he is free to travel is still a question. Hence the last part of the petition might need to be watered down to "release his passport"?

    You alledged that the Elections Dept only filed the complained after the elections and they are politically charged motivations. Please ascertain the facts first. The police report was made on Saturday, on polling day, not after the elections. From this, your argument of a politcally charged motivation falls because this was your basis of accusation.

    You have used strong and heavy words of accusation whilst the facts have not been confirmed and made known, thus guilty of misinformation and misguidance by swaying popular opinion using your blog. Your last 2 posts are prove of that, with the words you have used. I respect your wish to petition, and to make your opinions known, but be responsible and objective.

    I agree with what the electoral board is doing to get to the bottom of this Gomez saga. To me, it is a serious issue. The questions I have in my mind were:

    1. How can one who is running for an MP position be so absent minded?

    2. Did he not check his bag even once or thought he should check it when he was waiting for the call from the board... he had the whole morning... till 1pm!

    3. Ms Lam was with him, why did she not ask him to check before accusing someone else for the error?

    4. What would have happened if there were no CCTV. Will they accept an apology from the Civil servant that they had made a mistake?

    5. Will they make a mountain out of a molehill and claim that the board is trying to be "funny" against them? Will they try and discredit our electoral process.

    6. Vote for someone credible. We don't want Singapore to go the way of our neighbouring countries.

Mr Lee subsequently realised that he had made a serious mistake by saying such things, and publicly apologised for his remarks. This apology was accepted by the opposition parties including the WP. We therefore demand the PAP should be equally magmanimous in accepting the public apology of James Gomez.

    2. We, the Undersigned, demand an apology from Mr. Lee Hsien Loong and the PAP for making tasteless remarks about the WP, such as calling them the “Wayang Party”, and likening them to certain farm animals during the election campaigning period. We believe that this behaviour is unbecoming of the Prime Minister and ruling party who claim to be a gracious and First World Government.

    3. We, the Undersigned, demand that the PAP stop perpetuating fear and intimidation amongst Singaporeans in order to stifle public dissent by undertaking these legal actions against opposition members.

    4. We, the Undersigned, demand that the PAP stop denying Singaporeans our constitutional democratic rights including freedom of speech and press, and the right to peaceful assembly.

    5. We, the Undersigned, demand the fair and humane treatment of Mr. James Gomez.

    1. How come PM/seasoned politician can anyhow use words during rallies? Why so careless?

    7. Know the differences between credibility and absent-mindedness....not everyone is so perfect and holier than thee... It is precisely this condesending attitude of yours that is making our neighbours far and near dislike us. Dun pick on the speck in your brothers eye and ignore the log in your own eyes.

    Wah lao...didn't know our country so weak, forgive one person and we all die. As far as I'm concerned, people who's never make mistakes in their life never learn...just waiting to slip. Whereas, one who has erred will be extra cautious in action.

    I am highly suspicious of 'perfect' humans.....maybe they are aliens in disguise. I am not perfect and I'd cast my vote on the person who's like me. At least I'm sure he is human and not from Mars.

    point 4 of the former petition is not necessary since whether or not is popular at the polls, the pap stil put u down as long as u r a threat 2 their power.

    i hv signed the orginal but will not mind signing an amended one. its never a hassle 2 do something rite.

    one more point is that i think everybody should sign with their real names and not use nicks as this wil add 2 the petition's credibility.

    In the last election Mr Gomez failed to secure the minority certificate. This election, the same thing happened to him. But did he require the minority certificate in the first place? Why apply if he is not entering the GE as a minotiy candidate. Isn't he the one who started the whole issue? A mistake as WP claim it is. Fellow bloggers, put aside any prejudices and emotion and look at the issue clear-headed. Then you will realise who is making a mountain out of a molehill.

    Mr.LTK addressed this issue at one of his rallies and those who'd attended knows why it came about that Gomez was applying for minority cert (give u a hint- contingency).

    Perhaps before you allege prejudice and lack of clear head, examine your lack of information. Isn't it a bit too late for you to want to know why until now?

    Just ask yourself who has more to gain by making a storm in this tea cup. Are you buying the story that Gomez did it intentionally knowing that all alternative party candidates are scrutinized under a magnifying glass? Then by deduction, are you saying that Gomez is guilty because he intentionally got into a brush with the ED so that PAP will go after him so that WP will be implicated? Is this your line of reasoning?

    Singaporeans are prepared to forgive and let go because your line of conclusion flies in the face of commonsense.

    Criminal intimidation.
    503.     Just like ENRON and the famous ANDERSON CONSULING, the way to go might be to DESTROY evidence. else why ED why so confidence want to sue him ? God know what else is transpired between them that can prove he is innocent.

    Sorry quoting too many parallels between the first world American and ourselve but no one person/party/system is perfect. But one thing do stand out in the case of US or European, with their longer history they know long that no person/party/system is perfect and therefore they do value their so call 'check and balance' i.e. debates, media, freedom (protest/express) to dig out truth/lies. Democracy survived test of times as in most of those countries, many monarchy system falls usually lasting not more than 3 generations and that is a good chinese saying. Too bad as a young nation, we don't have all these luxury here because here we value stability and maybe economy more than other things. And therefore in this little red dot, 100 troublemaker to sued bankrupt for 100 years of peace is worth it (I think this is drilled into all PAP's head). That's why I recall someone said there are a lot of nice hardware/buildings here but the people has no soul.

    One things for sure, this would not stand the test of time. As we can already see the 'Thank-you' speech after the election is that most of the so-call GRC/SMC leaders with the exception of a few are not able to articulate their feeling about the sweetness of their victory because in their heart, maybe they felt that results are more or less expected, or thinking what am I going to manage my current job. There is no fire or passion at all ! Do you agreed ? The baptism of fire is not enough to cook that chilli crab you all wanted !

    Everyone knows in our heart that we need PAP to govern, even that we need passionate people to be our MP. To our PAP, for the sake of Singapore, it's time to let strong oppositions like WP, JG to survive and test the survival skills of your own very best in white. Only then, you are sure the people you have can withstand the test of REAL world and leapfrog us all to a REAL First World.

    JG was referring to the video footage by the two cameramen at the ED when he was filling up his form. He did not know of the surveillance camera footage yet.
    According to the surveillance camera video footage, JG waited until the two cameramen left, then he immediately stopped filling in his form and put the form in his bag. This evidence is definitely damaging to JG and proves he was lying when he said he was "distracted" and "forgot to submit his form". Sylvia Lim was also not with him at that time, so he was again lying when he said Sylvia Lim saw him submit his form. LKY was right after all.

After the merger with Malaya, lky had happily gone around brandishing Malaysian Malaysia (a clever strategy that would have propeled Malaysia forward) but was duly thrown out of Malaysia as a trouble-maker. His was good intention but was sacrificed for the common good of Malaysian stability then.

    To Singapore Election blog owners and anyone else,

    Well, the country deserves this for not voting LHL out. To nobody's surprise, it looks like they are now going to waste the country's resources, "fixing" the candidates who are not even in parliament anyway! Time is a valuable resource that the PAP should responsibly manage so that they can solve the country's real problems instead of running their own little personal vendettas (over non-issues).

    That said, this petition is not going to be useful unless real names are attached to it to lend credibility. But I doubt many people (myself included) will want to expose themselves and their loved ones by leaving their names on something as public as this. So setting one up will be a largely futile process.

    I rather prefer to act by exercising my choice on the vote instead. Even then, I hear rumours all the time about people with previous experiences where where they voted opposition and had to pay the consequences for it. This is an irrational fear. But I cannot say that I believe this is the case for the petition unless it garners major support from the people. This is something you cannot gauge from a dubious online petition with anonymous signees.

    Even if you do decide to take on the foolhardy course of action and set up a petition, it will have to be something more thoroughly thought out than this. I would suggest that you get the WP to organize one. The PAP is going to drag everyone of them even remotely associated with this through the dirt so they don't have much of a choice anyway.

    This will be a major exercise involving lawyers (if you can find anyone willing to represent you) to draft it, followed by a public document placed at a conspicuous high traffic location like Orchard Road or Raffles Place. You have to be sure to get the proper permits beforehand of course. If they can set up a giant book to sign birthday greetings for LKY, I don't see why this is going to be an issue though I am absolutely certain that the relevant authorities will make this seemingly trivial task feel like an impossibly unsurmountable administrative exercise.

    It will have to be left in place for at least a few weeks or even months to gather momentum as you will have zero mainstream media coverage except of course for negative publicity. People will only find the courage to do the right thing when they see others coming out in droves to lend their support. When this happens, not even the powerful LKY will be able to stop the winds of change.

    If you are not willing to do all that, the best thing to do is to put your heads down to the grindstone, concentrate on your jobs and take care of the ones you love first. The next time the election comes round, make sure you vote wisely and work harder to educate the blissfully ignorant around you that it is our responsibility to change a broken system, that is if you didn't already lose your right to determine you and your children's future by then.

    We want to spread a message. Up till now, many Singaporeans are still oblivious to the PAP's political tactics. This should simply be interpreted as sending them a reality check. We're simply voicing our opposition and letting people including the PAP know that there is dissent amongst Singaporeans.

    While the petition started because of James Gomez, I do not think that we've to simply revolve around him. There are issues that have led up to allow this kind of treatment, and we need to raise that.

    i highly recommend reading up about Mr. Francis Seow, Mr Tang Liang Hong, and several other opposition candidates who became immediate targets of the PAP after the elections. i would like to recommend the case on Mr Teh Cheang Wan, and how Mr Chiam S. T uncovered the case.

    as history is always written by the victors, i suggest reading up on all alternative sources, including the source from the singapore govt, so as you can get as many different perspective on the same issue, and slowly come to your own conclusion.

    perhaps having read all up on all the perspective on the issues, and 5 years later when you are able to vote, you might well decide to vote against the ruling party... just like every 1 in 3 Singaporean who got to vote in 2006.

    1. How would someone who is running for election be so absent minded? and we are talking about an important piece of document here.

    2. Why didn't Ms Lim who was with him say something when the matter blew up. Why did she keep quiet? A fair and just person would have gotten to the bottom of things and come clean.

    3. How is it possible that he did not once look into his bag all these few days? especially after he was told by the board that they did not receive the forms, didn't he think to just check his bag before threatening them? He had till lunch time that same day.

    4. What would have happened if there were no CCTV? Would he had made a mountain out of a mole hill and claim that he is being marginalised? ... maybe they wouldn't but its anybody's guess, isn't it?

    5. What would happen to our parliament if our MPs goes around and blames another follow human being when something goes wrong?

    For heaven's sake, we're talking about a 'minority' certificate! The last time this sort of things were required were during the apartheid regime! We're all Singaporeans; since when were we segregated based on our ethnicities?

    Hah. Dude, it's the PAP that's making a mountain out of a molehill, not the other way round! Mr. Gomez realized that he made a mistake, and he apologized. If anything, he's being a gentleman.

    Which begs the question, did the petition really work such that it garnered international attention that put pressure on the powers that be to leave the man in peace? I wonder if M.Ravi's letter to the United Nations had any effect either? I wonder what the U.N. Human Rights Council and Amnesty International have to say about the sad state of civil liberties in Singapore?

    A "minority cert." is your so called important document. Do you seriously think Gomez looks like a chinese? What is the IC for? The IC is not good enough to prove that Gomez is an Indian?

    Dude, I thought the media gave so much air-time for the so called "blunder" that Gomez did at the counter? Ms Sylvia Lim was at the ED with Gomez, but she was not physically present at the the counter at the time when Gomez forgot to hand in the form at the counter. Gomez had made a public apology on his "blunder" and the party had moved on, WP had already come clean, Gomez made a blunder and he had apologised. Why? Sorry also must explain? Why? Is it really necessary to explain why "Lopez said he told the Bar Chor Mee uncle he don't want Tur Kwa when he didn't say he don't want Tur Kwa?"

    Why not you try contesting in the next GE and see if you can breeze thru' all the administrative issues without making any blunders. People make mistakes at time, people apologised and we should all move on.

    Are you trying to enact 'Minority Report' here? Why not think about how the Govt. would be capable of misusing public funds and made everyone in Singapore a Pauper? as you have mentioned, "... maybe they wouldn't but its anybody's guess, isn't it?"

    66.6% victory in any election. i am not "party man" but eat your sour grapes and wait another five years to do try your luck. Oppo candidates keep saying that the pap mps never turn up in till elections, but i have seen my MPs and not once have i seen any oppo folk around. James Gomez is no hero neither is he a Villan. he lied and attempted to cover his tracks with bluster, maybe he didnt know he had it, maybe in the excitement of the election he forgot but is that the kind of person we want? he cost the WP a GRC. The issue of the IC not being enough to prove it while a silly argument was not put in place to prevent Gomez from joining the elections. It is disappointing to find so many people being led by hatred of the Lee clan and anything they touch. use your vote, talk logic not cock, prove that you care about the people not about the politics and you will win. Just ask LTK and CST. Start acting like this is a fight for freedom or should i say western style freedom and you wiill always be second best.
